Buyer security for 2nd hand goods??? UPDATE

well basically the guy is now refusing to have any contact. He's said that he's been more than reasonable (lol where?!), I've ignored stuff (er, the other guys never replied to me so what can i do) and that he thinks i wont send the rockers back to him.

Basically, he said he's 'chalking it up to experience and writing off the £110' he sent for the rockers, and doesn't want anything to do with me, all after i mentioned taking him to small claims. That still leaves me out of pocket, with a bunch of parts i can't use, and severely annoyed at his stonewall attitude.

Shall I just leave it, or is it worth pursuing??

Return the whole lot and get all your money back, then small clames court sor the P&P. You will only be able to proceed this way as you bought it as an assembly and If you start to cherry pick parts of the package it all gets very uncertain what you were buying and what is wrong with what. Further if you return the whole lot he has to try and sell it all when he gets it back he may want to avoid this and find you a set of pistons to replace the ones that are at fault. Most definatly do not sell any parts from the the "package" on to a third party as you will have then accepted it as a whole in the eyes of the law.

I did ask about a full refund be again he threw it back, despite offering me such a few months back. The things is, there are some of the parts that I do want to keep, and if i can't then that sorta fecks my whole new engine build up. Rock and a hard place and all that.

As it stands, i'm down about £250 total (considering everything other than fuel to go collect the parts). However, I have the two sets of pistons and the rockers now, which i could keep for a rainy day, so to speak? It does seem now that it's a whole lot of hassle just to prove that I'm right.

Personally spekaing i have far more important things in my personal life at the moment that warrant my full attention that worrying about suing some guy for a few hundred quid. It's prob not worth the stress now is it (hell, its caused enough for me and others over the past months!).

Postage etc will be your loss as will removing rods from pistons etc. As you are in different countries then litigation by either party isn't an option. I'd sell the rockers if I were you or certainly hang onto them until you get a satisfactory resolution. I wouldn't send them back at this stage.

well we've both agreed to disagree. He feels like I've been badgering him and pushing the fact he was wrong in his face, I feel like he's been ignoring the facts and not taking responsibility. We're both whining about losing money, despite the fact I'm down a lot of money compared to him. Ah well, more brilliant internet transactions to add to the experience board. Just wish I could have sorted it out that's all I've been trying to do all along!
