Just to pre warn every one,
had an alarming email this morning, (if i wernt having enough probs this year)

Got this mail this morning:

In the coming weeks, Vortech will no longer be able to serve the needs
of its current customers. I have been expecting this to happen for a
few months, so I have been preparing with a brand new H-sphere
reselling cluster (latest version 3.3), with much faster machines all
running the newest version of hsphere and the associated hosting
software (mssql 2005, mysql 5.x, and php5 on all Windows servers and
Unix servers). Along with keeping the software up to date we have
instituted policies to prevent our mail servers from being black
listed and to resolve the server side causes of site
defacements/hacks.

Right now we're still updating the site and adding more content, but
the company is Stability Hosting, and I am the VP of marketing and
sales. The site is
http://cts.vresp.com/c/?Stabilityhostin ... a8ad8efd2c
and we offer all of the features you expected of Vortech and a good
deal more. First off the spam assassin works properly and is kept up
to date; we also use another program instead of atmail called Horde
(much nicer, all inclusive atmail style, minus all of the problems).
As this is the standard webmail package with H-sphere it makes the
update process easier and allows us to keep the software up to date.
We have H-sphere version 3.3 with the latest patches, and we are up to
date with Parallels and will continue to maintain our support contract
with them. Everything in the control panel also works to perfection
and is maintained to the standards you would expect. We offer reseller
hosting which encompasses Linux and Windows hosting. We have the
latest versions of php, mysql, mssql, asp, and Windows that H-sphere
will support. We also have Windows 2008 licenses for when H-sphere
supports it in the 3rd or 4th quarter of this year. Our mail servers
have never been black listed and we have a very good outgoing and
incoming mail filter and more stringent policies to make sure such
problems don't arise.

If you would like some more information on this new cluster that is
run by myself (Dan Lewis), and my partners, please send an email over
to sales@stabilityhosting.com and we can get you setup on a more
secure faster service for the same price. I would urge you to make
arrangements before the last minute, to ensure that your sites do not
experience downtime. If you need assistance with migrations, Please
contact us as we may be able to help you through that process. We will
now actually have true 24/7 phone support as I am extremely tired of
the current lack of phone support at Vortech. If you're ready for a
change for the better, shoot me an email (or call 727-490-4360) and we
can discuss this further.

-Dan Lewis

Then this in reply:

In response to the email sent out today we feel it would be the responsible thing to do by clarifying a few things, most of which are public record and can be verified online at http://www.flmb.uscourts.gov/
Vortech, Inc. has been in Chapter 11 bankruptcy since July of 2009. Our potentially last Bankruptcy Court Date is 5/6/10 with Judge Briskman.

Regarding the email, we really are not sure what is going to happen with Vortech. There is a motion to dismiss/convert which means the trustee/judge could dismiss us and we would be unprotected from our creditors, most notably the IRS. To the best of my understanding of things, some very likely scenarios are as follows:

-Judge Briskman could convert Vortech, Inc. into a chapter 7.
-Vortech could also be run by the trustee or other court appointed party.
-Vortech in Chapter 7 could also be sold to a 3rd party.
-Vortech could be dismissed and allowed to make payments to creditors over time.
-Vortech's existing creditors which include the IRS, Colo Solutions, Hanging Moss LLC, Cogent etc, al. and several employees could attempt to collect the debt or take other action against Vortech, Inc.
-Former Vortech President and CEO Brad Pugh may file a plan to continue in Chapter 11 and try to run the company on his own.
-Not wishing to work with Mr. Pugh, current management may resign and/or turn Vortech over to Mr. Pugh prior to the May 6th Hearing.
-Current Vortech employees will be laid off sometime between now and May 6th, at which time Brad Pugh will take over with new employees.

The fact is, the remaining staff here at Vortech do not really know what is going to happen on May 6th. All we have been trying to do is keep everything going and run the company the best we can with what limited resources we have right now. To be fair, we have not been given any information from the Court, our Attorneys, Mr. Pugh or any other party that would indicate your service would be terminated without proper notice or warning.

Sincerely,
Vortech, Inc. Staff

Email i had from Vortech last night,
We are updating and upgrading mssql and mysql today. This will take a few days to roll across all servers. We're working in order of the most busy to the least busy.

MSSQL is getting a hardware upgrade, and a routing change. We found the issue with slow responses due to multiple sequential queries was being caused by delays between the cluster of web servers and the mssql servers. We're rebuilding mssql into new machines that are in the same local routing as the web servers. With this rebuild we're using faster drives, and upgrading the mssql to mssql2005 to support newer software.

Expect there may be minor down time gaps due to the moves. Once moved the old IP will still work, those using host names should not be affected. Changing IP to the new ones will result in faster performance for those who use IP addresses instead of host names. Hsphere will update to show the correct new IP addresses as well to prevent confusion.

Mysql is being upgraded both in hardware and software. They will start upgrading this evening, and we'll try to keep all of the mysql changes to late night hours helping to minimize complaints from Your end users.

This should solve the slow processing problems of sites using these services. We expect downtime of each server to be between 1 and 3 hours. It will vary on each server.
what about sites like us that have been down for 2 days not just a couple of hours :(
